Terms of Service

1. Acceptance of Terms

By creating an account, downloading, installing, or using the App, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the App.

2. The Service

The App provides a structured, multi-stage infant sleep-training program, night and day logging tools, progress tracking, insights, and reminders. We may modify, add, or remove features at any time.

3. Medical Disclaimer

The App provides general information and guidance about infant sleep for educational purposes only. It does not provide medical, psychological, or other professional advice, and it is not a substitute for the advice of a qualified physician or healthcare professional. Never disregard or delay seeking professional advice because of something in the App. Every baby is different; you are solely responsible for decisions about your child. If your baby has a medical condition, or you have concerns about your baby's health, sleep, breathing, or development, consult a qualified professional. In an emergency, contact your local emergency services.

4. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. By using the App you represent that you are a parent or legal guardian of the child whose information you enter, or that you are otherwise authorized to enter that information. A minor under 18 may use the App only with the involvement and consent of a parent or guardian.

5. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Provide accurate information and keep it up to date. Notify us promptly of any unauthorized use.

6. Partner Sharing

The App lets you invite a partner to share a household program. You are responsible for whom you invite and for the information you choose to share with them. A shared household member may view and contribute to the shared program and logs.

7. Subscriptions, Billing, and Renewals

Some features require a paid subscription. Subscriptions are sold and billed through the Apple App Store or Google Play and are managed by your store account. Payment is charged to your store account at confirmation of purchase.

• Auto-renewal: subscriptions renew automatically for the same period unless you cancel at least 24 hours before the end of the current period.
• Managing and cancelling: you can manage or cancel a subscription in your App Store or Google Play account settings.
• Free trials: any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.
• Refunds: refunds are handled by the app store under its policies; we generally do not control or issue store refunds directly.
• Price changes: we may change subscription prices; changes apply to future billing periods and, where required, with notice and your consent.

8. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms.
• Reverse engineer, decompile, or attempt to extract source code, except as permitted by law.
• Interfere with or disrupt the App, its security, or its infrastructure.
• Access the App by automated means or scrape data without our permission.
• Misrepresent your identity or your authority to enter another person's information.

9. Intellectual Property

The App, including its content, design, owl mascots, text, graphics, and software, is owned by Lullanest or its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use. The content you enter remains yours; you grant us a license to host and process it to operate the App as described in the Privacy Policy.

10. Disclaimer of Warranties

The App is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that any particular sleep outcome will be achieved.

11. Limitation of Liability

To the maximum extent permitted by law, Lullanest and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the App. To the maximum extent permitted by law, our total aggregate liability for any claim relating to the App will not exceed the greater of the amounts you paid us in the twelve months before the claim, or USD 150. Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Indemnification

You agree to indemnify and hold harmless Lullanest and its representatives from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the App, your violation of these Terms, or your violation of any law or the rights of a third party.

13. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the App. Upon termination, your license ends; sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

14. Changes to These Terms

We may update these Terms from time to time. We will update the "Last updated" date and, for material changes, provide additional notice. Your continued use after an update means you accept the revised Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Israel, without regard to conflict-of-laws principles. The competent courts of Tel Aviv-Jaffa, Israel will have exclusive jurisdiction, except where mandatory consumer-protection law in your country of residence grants you the right to bring proceedings locally.
